These terms & conditions apply whether a contract has been made verbally or in writing.
All quotations are given subject to The Company having available a suitable vehicle at the time the hirer accepts the quotation. Quotations are given for coach & driver only. Quotations are valid for 3 days unless otherwise notified.
The hirer cannot assume the use of the vehicle between outward & return journeys, nor that it will remain at the destination for the hirer's use unless this has been agreed with The Compa-ny. The Company reserves the right to levy additional charges for additional mileage or time to that agreed. The charges will be pro rata & in accordance with booking confirmation.
The hirer acts on behalf of all passengers travelling on the vehicle. The hirer is responsible for ensuring that all passengers comply with these terms and conditions and is liable for any damage or costs incurred as a result of their actions.
The law strictly controls the driver's hours of driving and rest periods, and the current regula-tions must be complied with. The company will agree the hours of operation of the hire, and these must be observed.
The maximum numbers allowed on the vehicle is indicated on the vehicle. No standing pas-sengers allowed. Drivers will not carry an extra passenger over the seating capacity.
Animals will not be carried on any vehicle, except authorised guide dogs.
While we aim to provide vehicles equipped with amenities such as air conditioning, Wi-Fi, and toilets where applicable, the availability and working order of these facilities cannot be guar-anteed. The Company will not accept liability for the failure of any on-board facilities.
Invoice payment terms are five days from date of invoice unless a different term has been agreed. Any deposit requested must be paid by the time stated, and payment in full must be made before the start of the hire unless The Company has agreed to a variation in this condi-tion. The Company reserves the right to add 10% per annum above the base rate calculated daily from the date by which payment should have been made.
If the hirer wishes to cancel giving 72 hours' notice, there is a 50% fee of the total booking amount. If the hirer wishes to cancel within 48 hours of the booking, then the full amount will be charged. Amendment to the date /time/number of passengers can be at company discre-tion Cancellation due to inclement weather conditions will be charged as above. Thea-tre/concert tickets already purchased are not refundable & must be paid for in full. Accom-modation, meals etc. arranged on your behalf by our company may be liable for a cancella-tion charge. Any deposit of up to £200 paid for bookings where accommodation, meals, fer-ries & other services are being reserved, will be liable to retention in the case of cancellation by the hirer. This will cover administration costs incurred, and deposits forwarded to third par-ties. The amount to be kept in such an instance will be decided at the discretion of the Com-pany.
In the event of an emergency or an action by the hirer to vary the agreed conditions, the company may return all monies paid and without further liability cancel the contract.
The Company may provide a larger vehicle than the size hired at no additional charge. The company reserves the right to hire another Coach Operator to cover the hire.
The route used, unless the hirer has advised of a particular route or places to be passed en-route, which will be specified on the confirmation letter, will be at the discretion of the compa-ny and/or the driver.
The Company allows a grace period of 15 minutes for all scheduled pickups. Delays beyond this may incur additional charges. For airport collections or other time-sensitive pickups, it is the responsibility of the hirer to provide accurate and updated timing information.
The Company gives advice on journey times in good faith but does not guarantee the com-pletion of a journey at a specific time and will NOT be liable for inconvenience or loss caused by breakdown or delay.
The Company reserves the right to subcontract to other coach operators. All subcontracted operators will meet the same safety and legal standards required by The Company.
When the company provides meals, accommodation, ferries, admission tickets and any oth-er services provided by another contractor, it does so as an agent of the hirer on his behalf. Any terms and conditions imposed by the contractor will be binding on the hirer as if he had directly contracted the services himself.
Passengers are permitted to bring a reasonable amount of luggage. The Company reserves the right to refuse items it deems unsafe or excessive. Passengers are responsible for their luggage, and The Company accepts no liability for loss or damage unless due to proven neg-ligence.
All vehicles hired are subject to restrictions on carrying luggage for statutory safety reasons & the driver shall be the sole judge as to whether & to what extent passengers' property is car-ried. The Company will not accept liability for any damage or loss of any property, which be-longs to any passengers and is left on a vehicle. Any articles of found property recovered from a vehicle will be held at the depot from where the vehicle is based and may be collected from there.
All hirers and individual passengers are recommended to obtain insurance for those items where, save for negligence, the company's liability is limited (such as delay or luggage).
The driver is responsible for the safety of the vehicle. Any passengers whose conduct is in breach of statutory regulations will be removed on the driver's authority. The hirer will be re-sponsible for all damages caused to the vehicle by passengers during the hiring.
The Company reserves the right to implement health and safety guidelines as necessary in accordance with government or local authority regulations. Passengers must comply with all such guidelines to ensure the safety of all aboard.
Complaints must be submitted in writing within 14 days of the date of hire. The Company will acknowledge receipt within 5 working days and aims to resolve complaints within 14 working days.
No bill, poster or notice is to be displayed on any vehicle without prior consent of The Com-pany.
Under no circumstances may alcoholic drinks be carried on or consumed upon the vehicle.
All coaches are non-smoking.
The quotation given is based on operating costs at the date of the quotation. When more than 28 days elapse between the date of the quotation and the date of departure, the company reserve the right to pass on to the hirer any increase in the cost of fuel or any other increased costs resulting from Government action.
The Company shall not be liable for any delay or failure to perform its obligations due to cir-cumstances beyond its reasonable control, including but not limited to adverse weather con-ditions, acts of God, or civil unrest.
The Company will process all personal data in accordance with current data protection legis-lation. Data will only be used for the purpose of fulfilling the contract and will not be shared with third parties without the hirer's consent, except where required by law.
The contract will be governed by the laws of England and Wales, and any disputes shall be dealt with in the courts of England and Wales.
